AU Milk - THE Good Food Everyday COMPETITION

This document sets out the Terms and Conditions for This document sets out the Terms and Conditions for The a2 Milk Company (Australia) Pty Limited ‘Good Food Everyday’ social competition. 

Background

1. The Promoter is The a2 Milk Company (Australia) Pty Limited (ABN 52 125 331 213), PO Box 1564, North Sydney, NSW 2059. To contact the Promoter, please email [email protected].

2. Information on how to enter, and the prizes, form part of these conditions of entry. Entry into the Promotion is deemed acceptance of these conditions of entry.

Eligibility

3. Entry into the Promotion is free (excluding internet charges) and is open to all individuals who satisfy each of the following eligibility criteria: 

a. are a resident of Australia

b. own the Instagram account used for the entry submission; and

c. are aged 18 years or over at the time of entry (together, the Eligibility Criteria)

4. Directors, officers, management, employees and contractors (and their Immediate Families) of the Promoter and its related bodies corporate are ineligible to enter the Promotion. Immediate Family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin (by blood, marriage or relationship).

5. If at any time an Entrant (defined below in cl 7) contacts the Promoter in writing and withdraws their consent to the use of their personal information given to the Promoter in the Promotion, under the Promoter’s Privacy Policy (https://a2milk.com.au/privacy-policy/), the Entrant will no longer be eligible to participate in the Promotion.

Entry Requirements

6. The Promotion commences: 12.01am (AEST) on 04/07/2026 and finishes at 11.59pm (AEST) on 18/07/2026 (Promotion Period).

7. To enter the Promotion, entrants who meet the Eligibility Criteria must enter the Promotion during the Promotion Period via Instagram by; 

a. Following @a2milkau, @garymehigan and @goodfoodeverydayaus;

b. Like the post which was posted collaboratively between @a2milkau, @garymehigan and @goodfoodeverydayaus which states ‘Enter for your chance to win, Ninja Luxe Coffee Machine valued at $799’ (Post);

c. Tag a friend in the comments of the Post; and

d. Leave one original comment on the Post answering in 25 words or less ‘Why you love a2 Milk® in your cooking/drinks’.

(each an Entry, and the entrant who submits an Entry being an Entrant).

Any costs associated with meeting the Eligibility Criteria must be met by the Entrant and not the Promoter.

8. Entries must be the Entrant's original work. The Promoter reserves the right to require the Entrant to verify that the entry is the Entrant's original work. If the Promoter is unable to verify that the Entry is an original work to its satisfaction, the Entry will be deemed invalid. Entrants warrant that their entry is not in breach of any third party intellectual property rights.

9. Multiple unique Entries are permitted subject to compliance with these Terms and Conditions. In the case of an Entrant entering the Promotion with more than one Entry, then all Entries from that Entrant will be considered. To enter multiple times, an Entrant is to repeat the steps outlined in 7(c) and 7(d) for each unique entry.

10. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries.

Prizes

11. There will be one Winner for the Promotion. The prize is one (1) Ninja Luxe Café Premier Espresso Machine in colour stainless steel (valued at AUD$799) the Prize, and the Prize winner, the Winner).

Determination and Notification of Winner

12. This is a game of skill and chance plays no part in determining the Winner. The judging criteria being used in determining the Winner is: 

a. the creativity, originality, humorousness, emotional appeal and relevance of their Entry;

b. The relevance of the Entry to the Promotion and any other factor that the judges consider relevant in determining the winner of the Prize;

c. The determination will take place at the Promoter’s premises at Level 3, 2 Southbank Blvd Southbank VIC 3006 Australia.

13. The Winner will be selected by the Promoter based on the judging criteria set out in clause 12 above. The Promoter's decision is final. No correspondence will be entered into.

14. All valid entries will be reviewed and selected by a panel of 4 judges from the Promoter and/or its nominee at 10:00am AEST on Monday 20 July 2026 at the Promoter’s Address.

15. The Winner will be notified by direct message on Instagram by 5:00pm AEST on Tuesday 21st July 2026. The Winner will have five (5) business days from notification to respond to accept the Prize, or will be deemed to have forfeited their prize (Unclaimed Prize).

16. Should the Winner of the Unclaimed Prize remain uncontactable by 5:00pm AEST on Tuesday 28th July 2025, a next best Entry will be selected for the Unclaimed Prize at 9:00am AEST on Wednesday 29th July 2026 and will be notified by direct message on Instagram by 5:00PM AEST on Wednesday 29th July 2026.

17. At the same time as notifying the Winner of their winning Entry in accordance with clause 15 or 16, the Promoter (or its nominee) will request the following information to allow the Prize to be awarded: 

a. the Winner’s name, phone number, email address, and any other information reasonably required to verify their identity and adherence to the Eligibility Criteria and to enable the Prize to be awarded to the Winner; and

b. confirmation of the Entrant’s consent to the use by the Promoter of the names of any individuals featured in the Entry and/or the Entrant’s social media username under the Promoter’s Privacy Policy,

prior to awarding the relevant Prize. Failure to provide either of the above categories of information/confirmation will be deemed as a forfeiture of the Prize and the Promoter retains the right to choose a substitute Winner for the Promotion.

18. The Prize must be taken as offered. No modifications or exchanges will be possible, except as set out in these Terms and Conditions. The clause does not set out to limit any rights under Australian Consumer Law.

19. The Promoter reserves the right to validate and check the authenticity of any Prize claim or Entry before awarding the Prize.

20. The Promoter’s decision in relation to any aspects of the Promotion is final and binding on every person who enters and no correspondence will be entered into.

Nature of entries

21. All Entries are subject to moderation and may be rejected or removed if, at the absolute discretion of the Promoter, the Entry: contains offensive, derogatory or threatening material in any way;

a. contains material that conveys hatred or harm against any group or person, or otherwise does not comply with the theme and spirit of the Promotion;

b. contains personal or sensitive information;

c. is unlawful or violates an individual’s rights;

d. is incomplete, indecipherable or illegible;

e. contains any content, material or element that is shown to be the property of any third party;

f. contains any incorrect, misleading, deceptive or fraudulent information, including any claims about a2™ branded products which may be misleading or deceptive; or

h. is boosted in engagement through illegitimate means, coercion, or bad faith.

22. The Promoter will not be held liable for any failure of receipt of Entries. The Promoter takes no responsibility for any Entries which are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid.

23. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the image recording device user or for any of the equipment or programming associated with or utilised in collecting data for this Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

24. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, failed to meet the Eligibility Criteria or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

Ownership and Privacy

25. The Promoter reserves the right, at any time, to request that an Entrant promptly provide identification (including but not limited to proof of identity, proof of age and proof of residency) to verify the Entrant’s identity, age, residential address, eligibility to enter and participate in the Promotion and to claim a Prize (each, a Proof).

26. If an Entrant refuses or fails to produce a Proof to the satisfaction of the Promoter (in its sole and absolute discretion) within a reasonable time period specified by the Promoter, the Promoter may deem the Entrant ineligible to participate in the Promotion.

27. The Entrant must be the sole author and owner of the copyright of the content of their Entry.

28. By entering this Promotion, Entrants (i) grant the Promoter a non-exclusive, perpetual, worldwide, irrevocable and sub-licensable transferable licence to use the language contained in their Entry, or any part of the content of the Entry in any way the Promoter wishes (including modifying, adapting, copying, editing, publishing, broadcasting or communicating the entry whether in original or modified form in whole or in part) in all media for the purposes of the Promoter’s business on its website, social media or in any marketing campaign, without payment to the Entrant of royalties or compensation. If requested by the Promoter, Entrants agree to sign any further documentation required by the Promoter to give effect to this clause; (ii) consent to the Promoter dealing with their entry content in any way that may infringe the Entrants’ moral rights, and agree to waive their moral rights (wherever such rights are recognised) in respect of their entry against the Promoter or its assigns, licensees or successors; and (iii) consent to the Promoter using their name, likeness, image and/or voice in the event that they are a Winner in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting this Promotion (including any outcome).

29. Entrants warrant that: 

a. they will not submit, produce, upload or share any content that is fraudulent, or may be in breach of any intellectual property, privacy or other rights;

b. no rights in the Entry have been previously granted to any person, corporation or entity; and

c. they will comply with all applicable laws and regulations including without limitation those governing copyright, content, defamation, privacy, publicity and the access of use of others' computer or communication systems.

30. By entering this Promotion, each Entrant acknowledges and consents to the Promoter collecting and using the Entrant’s personal information (including any information submitted by the Entrant as part of their Entry) to include the Entrant in this Promotion, for the facilitation of the granting of the Prize, for any promoting of the Promotion by the Promoter or any advertising of the Promoter and publicity of the outcome of the Promotion. Collection and use of the Entrant’s personal information is governed by the Promoter’s Privacy Policy at: https://a2milk.com.au/privacy-policy.

31. Entrant details will not be used for any purpose other than those specified in these Terms and Conditions.

To facilitate an Entrant’s participation, the Promoter may disclose the Entrant’s personal information to other companies associated with this Promotion, including the Promoter’s related bodies corporate, agents and/or contractors to the extent necessary to facilitate this Promotion.

Limitation of Liability and Indemnity

32. The Entrant indemnifies the Promoter against all loss, damages and costs incurred by the Promoter as a result of any breach of any law by the Entrant, including any entry of an image by an Entrant that breaches the copyright or privacy of a third party.

33. To the extent permitted by law, the Promoter (and its officers, contractors, employees, agents and representatives) will not be liable for any injury (even if caused by negligence), loss (including loss of opportunity), damage (including, but not limited to, direct, indirect or consequential loss), cost, expense or claim arising from or in relation to: 

a. the Promotion;

b. any Entry; or

c. any tax liability incurred as a result of being awarded a Prize.

34. Instagram may be used to advertise or promote the Promotion. By entering the Promotion, Entrants acknowledge that the Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram; and agree to release Instagram from all liability in relation to this Promotion. Any questions, comments or complaints regarding the Promotion should be directed to the Promoter and not Instagram.

General

35. Should an Entrant's contact details change during the Promotion Period, it is the Entrant's responsibility to notify the Promoter. A request to access or modify any information provided as part of the redemption of a Prize should be directed to the Promoter in writing.

36. If this Promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion but subject to state and territory laws, to modify, suspend, cancel, recommence or extend this Promotion or to disqualify any individual who has tampered with the entry process.

37. If any term or condition of these Terms and Conditions or the application thereof to any person or any circumstance shall be or become illegal, invalid or unenforceable, the same shall be read down, if such reading down is possible, and if found to be impossible, shall be severed and the remaining terms, agreements and conditions shall not be affected.

38. These Terms and Conditions are to be interpreted in accordance with the laws of the State of New South Wales and all parties submit to the exclusive jurisdiction of the Courts of that State.
